The cause of the whole disaster was the robber - for that he needs to be convicted and sentenced, substantially.
But the jerk off who shot an innocent co-worker to stop the theft of a hamburger is out of this world stupid and should be charged with reckless manslaughter.
No excuse for that - now if the perp was attacking the worker with a weapon that is totally different = but from a drive-in window he was not a physical risk. run outside and shoot out his tires.
