Yeah, this is where I am bothered. If he really was in that bad shape that morning, you go straight to the hospital. Or, you call the police and ask for a 72 hour hold.
You DO NOT make stops along the way.
He may well have PTSD and he may well need help but none of that excuses his behavior on that day.
Having said that this is one of those times where I feel the appropriate penalty isn't jail time but rather ensuring the victim is made whole, and a significant amount of community service hours... perhaps targeted towards veterans with PTSD.
