TDM was the initial aggressor. He went over there in an aggressive manor, instigated and escalated an entire situation, verbally assaulted the man, threatened him with violence, swung at his face (whatever you want to call that), sorry but all fault bets are off at that point. This isn't a 100% argument needing to be made, TDM dug his own grave.
None of that changes the fact that the old man following him was not a wise decision. Do you think that was a good idea? You can't say "it doesn't matter" because that doesn't make any sense at all, it 100% matters because it happened.
Both can be true, they are not mutually exclusive.

well so many variables. old man may have a lot of pride about the stance he took. maybe his jaw getting sewn up will help him lose some weight and he gets a few years of added life to watch his grand kids play some more travel bawl. I don't understand in what context you want me to subjectively answer a question that you admit its relevance is slim to none.
