re: Arkansas sherrif illegally arrests mom and teenage son

Since the charges weren't filed by the DA, they didn't need a "bail poster". That's what happens when police make illegal arrests.
Enlighten Moi!!! What does your comment have to do with the police trampling over these people's right's??

To arrest someone in their home you need a warrant unless there are exigent circumstances.

You're right, you're no LE expert. Anyone with common sense knows that police can't arrest someone in their home w/o a warrant unless there are exigent circumstances. No court in America would consider revving an engine exigent circumstances. It doesn't matter how many warnings were given earlier, police still need an arrest warrant. The arrest of the son is ridiculous. His only crime at the time of his arrest was not responding to the sheriff's lecture...which isn't a crime. Regarding the mom, her arrest was illegal as well. The curtilage(which would include the porch) is considered a part of the home, thus a warrant is needed. Finally, all charges were dismissed by the DA after the police presented the case. For a small town, that says a lot. My advice to you would be, check out the Civil Right's Lawyer on the tube.
