The problem is that when some of these laws were written, it was not humanly possible to project every possible scenario of what could happen. I think some of it was written with an element of common sense invoked within the wording but apparently common sense was wrongly assumed to be a staple of life through the years...

Confused. Why wouldn't they? Looking at intent isn't the same as rewriting or disregarding the text.
