I'll have to find the video again. But it clearly shows he is going 5 mph, the back of the car is struck by a person who walks out into the street to hit it, and then he accelerates forward.
To me, the defense could go a few different ways with this; but if that video makes it into the evidence, then he walks on a murder charge.

Doesn't quite pass the initial sniff test. Guy was an active Obama supporter and was at the helm of many of the Occupy Wall Street protests. He was a CNN assignment reporter.
