Why didn’t they take the documents in June when they first visited
Apparently, a member of Trump’s legal team signed a legal document swearing and affirming that ALL classified material that had been stored at Mar-a-Lago had been returned to the government during the June visit by federal investigators.

I'm so tired of this authoritarian theater. It gets people on both sides fired up, drags on way too fricking long. If it's not one scam it's another. They have such a hard on for this guy and keep serving up dud after dud.
It excites the lunatics that believe Trump is a literal Nazi, yet he still hasn't been jailed for a damn thing.

Because when the news broke during prime time tv on Monday it reached more people that Trump is a criminal. You know, warrants amd raids mean you are guilty of something serious

Which brings about the issue of what was and is classified as it pertains specifically to the law(s) involved, amongst the material in question. Just seems like a giant step to take to storm the personal residence of the immediate past President when there’s plenty more pointing to a lack of pr very serious question in terms of the mens rea aspect of the law involved, in addition to the fact that there was, by admission of all parties, an open spirit of cooperation between the government and the Trump people, in addition to the very careful approach that is urged when a potential political campaign is on the horizon, in addition to the public skepticism involved due to the shockingly high number of prior efforts to stick Trump with criminal liability.
All that added up leaves me without question whatsoever the abhorrent nature of this scheme. Leaving us with one of the nastiest stains on our government in the history of the country.

I think all of the points you made (what was classified, mens rea, etc) would need to be addressed by the Feds if Trump is charged.
Concerning the spirit of cooperation, Attorney General Garland probably felt that Trump wasn't acting in good faith when a lot of classified documents were reported by the Mar-a-Lago informant (whoever that is) AFTER Trump's lawyers assured him that ALL classified documents had been returned to the U.S. government.

Fair enough. Points taken, even if not agreed upon. As far as the legal question of what’s classified and mens rea and such, true, the fed court would ultimately weigh in on that, but what I mean to say is that the DOJ must have made a preliminary finding of existence of classified material and resultant violation of law in order to take the drastic step of seeking a warrant to begin with, particularly in this sensitive situation. IMO there were too many mitigating factors to take this drastic step, the totality of the circumstances, the ones I mentioned in my previous post.

I see your points as well. It probably could have been handled in a less heavy-handed manner. I think we are early in this process and a lot more will come out in the coming days/weeks. It will be interesting.....

Does the fact that the FBI team that executed this search is under investigation for abuse of power in Russia hoax change anything?

They didn't want Trump there. We already know that. He was in NY dealing with another witch hunt.

If that’s the case, most definitely would be an unpleasant cross examination of the agents as to their credibility. It would be nice to poke and push them until they possibly lose their cool on the stand. Just that would be satisfying.
