I pointed out in another thread that the DC Circuit unusually issued a Kavanaugh opinion today. That, to me, is a strong signal they are trying to wrap up what they can with him before tonight.

I like Kavanaugh. Scores highest on the Scalia Index of the remaining candidates. I don't care if he's going to be hard to get confirmed. Nominate the best and prepare for a fight.

I just hope that Trump picks someone that won't be a swing voter and will stick with conservative values and vote as a staunch constitutionalist

Kav is going to be a swing vote.

Kav gave Roberts the rope to save the ACA.

It could just as easily be a Kavanaugh trying to wrap up business on his own with the hope that it’s him. I think it’s likely to be him, and I would be happy.

His only real blemish is not being in favor overturning Roe (which isn’t the case that needs to be overturned anyway - it’s Casey). But, I for one don’t think the Chief will overturn it either. They’ll just gut them by finding that no restriction is an undue burden.

He seems to be pretty much in following of Scalia more so than the other nominees from my reading, would you say thats accurate?

Supreme Court Announcement : In Game Thread

Brutal honesty here: the fact this announcement has generated an in game thread demonstrates how much power SCOTUS has acquired and consolidated since our nation's founding, completely contradicting the intent of the Constitution's framers that is all hopefully I'm pleased with President Trump's appointee when I rise from my slumber

I think Kethledge is more “Scalia-like,” but it’s splitting hairs. Kavanaugh’s record is solid, and his background is eerily similar to Scalia’s.

I think Kavanaugh will be a reliable Alito-like vote, with some idiosyncrasies that will piss off conservatives every now and then.

Did Judge Brett Kavanaugh write the roadmap for saving ObamaCare?

That question has dwelled at the center of passionate debate in the conservative legal community for days as Kavanaugh, a federal appeals judge in the District of Columbia, finds himself as one of President Trump’s four finalists for a place on the U.S. Supreme Court.

Trump is expected to announce his choice to fill Justice Anthony Kennedy's seat Monday night. He has not tipped his hand, but Kavanaugh from the start has been in the mix as a top contender -- fueling a firestorm of debate on the right.

The allegation from conservative critics is rooted in a 2011 ObamaCare case where Kavanaugh dissented against the ruling but acknowledged that the Affordable Care Act’s “individual mandate provision” could fit “comfortably within Congress’ Taxing Clause power.”

Kavanaugh's detractors say that language helped provide the roadmap for the Supreme Court to uphold the mandate a year later.

Yea. The court rejected that out of hand. I don’t know how it was a road map.
