The basis for dismissal was his improper appointment I thought. How does this address that in any manner?

You’re thinking of the classified documents case in Florida where the district judge went totally off the rails and will be slapped down by the 11th Circuit.

That was Florida

This is DC, where Jack Smith is legally appointed, per DC Court of Appeals precedent.

This is rather benign. He removed the clear allegations that the recent USSC made improper under Presidential immunity.

He didn't add any new charges or change the substance other than to follow the USSC ruling.

Isn't Smith the guy who was deemed to be illegally appointed as Special Prosecutor? Since he's not a legitimate prosecutor, can't Trump tell him to go pound sand? Shouldn't the court tell him to go pound sand as well?

They are absolutely going to imprison Trump if he loses. No doubt in my mind they will lock him up forever.

Hell they still might do it before the election if they are desperate enough.

Executive privilege =/= immunity.

That said, this was expected. Now Trump's lawyers will tee up the same constitutional challenge to Smith's appointment and spending and the judge will dutifully follow DCCCA and it's off to the Supremes again.

Of course, Trump will just fire him and every fricking AUSA on 1/20/25 so it will be all good.
