Sure but the reason Congres shirked this duty is the same reason your idea becomes a problem. Congress is not always good at resolving real issues that are either (a) divisive or (b) so technical the general public doesn't give a shite.

That is an interesting counterpoint for sure.

ETA: My take is that I would rather live with the chance of Congressional uncertainty than momentous 5-4 decisions changing the direction of the entire country.
