ACB - would a decision in your favor call any of the stare decisis and other privacy cases (gay marriage, etc) into question?

Mississippi- none of those others involve termination of a human life. And all of them make clearer rules that are grounded in law/traditions. Roe came out of the air.

Latina - how is this not religion to say that we assume a fetus is life at when.

Mississippi- this court recognized that we are talking about a human organism before viability.

Latina - when does the life of a woman enter the calculus. Poor people are put at risk in giving birth id they can’t have an abortion

Kagan - usually there has to be a strong justification beyond you think the case is wrong. Not much has changed since Casey- people have always had opinions on this topic, and some ppl always thought wrong. So how do we overrule with Stare Decisis and this has become part of fabric of society.

(I think Roe is wrong, but this question makes sense from a legal standpoint).

Answer to Kagan - we’ve had decades of damage caused by Scotus pulling Roe out of the thin air. There is no objective standard in Const or Statutes for them to fall back on so judges are left with their personal views to decide

Roberts - you changed your focus from your brief for getting us to consider this case - and in your brief on the merits you focused more on stare decisis.

(This question is stupid and unanswerable- Mississippi does ok)

Kagan - asking if we don’t overrule roe- you suggest that we use the undue burden standard to future abortion cases. That is unworkable?

Mississippi- says yes. This is the problem
