Kagan - usually there has to be a strong justification beyond you think the case is wrong. Not much has changed since Casey- people have always had opinions on this topic, and some ppl always thought wrong. So how do we overrule with Stare Decisis and this has become part of fabric of society.
(I think Roe is wrong, but this question makes sense from a legal standpoint).

Answer to Kagan - we’ve had decades of damage caused by Scotus pulling Roe out of the thin air. There is no objective standard in Const or Statutes for them to fall back on so judges are left with their personal views to decide

Kagan - asking if we don’t overrule roe- you suggest that we use the undue burden standard to future abortion cases. That is unworkable?
