They states something like he reached towards his waistband that made them think he might be armed . Or maybe reached to pull up his sagging britches? How did he threaten?
I've only seen this incident paraphrased by various media outlets, so I don't know. I'll have to wait and see in trial.
The entire point of this thread is to wait until a court case either finishes, or gets a good bit into it before taking such strong stances of guilt or innocence.

quote:either way travis has no immediate knowledge of a felony, he was informed and recruited by his father after seeing AA running down the street. nothing you say changes the fact their own words admit they had no knowledge of a felony when initiating their CA.
Neither of us knows Georgia's caselaw, but perhaps Travis' knowledge is brought back closer to this incident because he recognized Arbery from a previous incident.
quote:
Also if you want to sound like someone who knows what they're talking about, and that's why you're so confident you can type the things you type, at least use the proper terminology. It's not "direct knowledge", it's immediate knowledge.
you seem to acknowledge understanding of my point, no need to huff and puff about word choice. go ahead and imagine i say within his presence or within immediate knowledge. either way regardless of the synonyms I used the mcmichaels did not satisfy this portion required.
quote:
- You argued that even if we agree that the McMichaels met the criteria to begin a citizen's arrest, that in and of itself doesn't mean that they followed the law throughout the entire citizen's arrest process. That deviating from the law could/likely would change them from citizen's attempting a lawful citizen's arrest to criminals committing some form of assault.
- I operated under that assumption, and said that the "Stop or I'll blow your brains out" remark might have been aimed at Arbery reaching into his waistband while running from the McMichaels. In that scenario, however unlikely it might be, it wouldn't be a threat for someone to stop running or they'll be shot, it would be a warning not to draw a weapon or they'll be shot.
right. I know you are just fabricating hypothetical defenses despite the fact that the defense is not even claiming that scenario. This was their statement about making that threat:
quote:
"I said stop," Gregory McMichael said, according to the transcript. "I'll blow your f**king head off, or something. I was trying to convey to this guy we were not playing, you know."
they have never claimed to be fearful he was reaching for weapons to attack them during the chase. they were trying to intimidate him into compliance with deadly weapons. none of them have claimed they believed he was reaching for anything. that is you fabricating hypotheticals.

that was weeks prior to the shooting. azkiger continues to try to conflate separate events weeks apart and fabricating hypotheticals to justify the defense.
quote:
"Travis saw him in the yard and Travis stopped," he said.
"He confronted (the man) halfway into the yard. He said (the man) reached for his waistband, and Travis got spooked and went down the road."
“Yeah, it just startled me,” McMichael responded. “When I turned around and saw him and backed up, he reached into his pocket and ran into the house. So, I don’t know if he’s armed or not. But he looked like he was acting like he was.
Mcmichaels doesnt even claim AA made threats, just that he was acting spooky. here we have actual statements by the mcmichaels and we have azkigers imaginary scenarios.
