OK first this is happening in LA, Cali.

quote:

Feds Drop Homemade AR-15 Case for Fear of Hurting Wider Gun Control System

quote:

CNN reports that Roh allegedly had machines to manufacture AR-15s in a warehouse outside Los Angeles. Customers could come to the warehouse and allegedly build their own rifles “for about $1,000.”
Roh allegedly maintained his business, even after ATF officials warned him ‘in person…that he was breaking the law.”

Roh was eventually indicted, only to have federal authorities drop charges after prosecutors grew worried that a ruling in the case would be detrimental to the larger gun control system.

Here's the dumbfrickery gem:
quote:

They specifically worried the 1968 Gun Control Act could be endangered and that a trial might “seriously undermine the ATF’s ability to trace and regulate firearms nationwide.”

America would be better off without the ATF.

I.e. prosecutors with a good understanding of constitutional law believe that the legislation would not stand up to a serious judicial examination, depending on the court.

It's ridiculous to equate renting a milling machine to building a firearm for someone.

He will be audited every year, subjected to safety and compliance inspections ad naseum.
Eventually the money he makes won’t be worth it and he will quietly go to work for the man.

For those not sure what this is all about - you can complete a 80% lower with CNC machining equipment for your own personal use and there is nothing the Feds can do about it.

You can't sell it. You can't even finish one for someone else, but the grey area here is renting out a space with all the equipment you need for this express purpose.

The last thing the ATF wants is a SCOTUS decision that says that is completely okay. They want that decided with a different court composition.

They're playing the long game here.

Alcohol, Tobacco, and Firearms should be a convenience store, not a federal agency.

The easiest law to use to get in front of the courts is the Lautenberg Amendment, which is a continuation of the '68 Gun Control Act. The Lautenberg Amendment is even more egregious; it's unconstitutional based on ex post facto....and it doesn't require a law degree to understand it; it says that if you've EVER been convicted of domestic violence you lose your gun rights.
