The lungs themselves are not a muscle. The bronchial system does but that has nothing to do with a fentanyl overdose. The muscles involved in breathing are the internal and external intercostals, primarily the diaphragm and occasionally the scalenes. Accessory muscles come into play in the event of injury like a high spinal cord injury but that pretty irrelevant to an opioid overdose. Although you probably get an overall muscle weakening of all muscles; not only those of breathing but I suspect it's more of a CNS depression of all bodily functions as you get slowed heart rate as well as low blood pressure.
If fentanyl overdose is going to be their defense then someone is going to have to explain why they didn't administer naloxone (narcan).
