Local politics - Hammond City Council

Out of the 5 council members, 3 are termed out, one is stepping down, and the other may not win re-election thanks to her telling a constituent she would be one behind his ear on police body cam footage.

Anyways, we have Sam Divittorio running for the district 4 seat. He owns a few properties under an LLC within the district, however, his home is located outside of the city limits. The charter and state clearly state you have to live within the district to run. He is trying to say he lives in either a warehouse he and his brother owns, or one of the low income efficiency units they own together.

How is it possible he is allowed to run? Seems it should be illegal.

There is nothing stopping a candidate from filing and running. That doesn't mean they cant be disqualified.

I get that, but how do you prove he actually lives in his house? He shows up with a copy of his DL on the day to qualify showing his address to one of his other properties. Is that what they go by? Or do you have to provide where you claim homestead exemption at?

Does he complete a form that requires him to commit perjury if he lies?

If so, let him complete the paperwork then put a PI on him to prove where he lives.

Prove he is lying then arrest him.

Says this when you look on the LA SOS website about becoming a candidate.

"Your candidacy may be challenged if you are not qualified to run for the office and you may be criminally charged for executing an affidavit knowing it to contain false or incorrect information."

You challenge it and make them produce eveidece to support their candidacy, in this case rent/loan payments, pertinent mail going to that address like checks or magazines, or tax documents that show that individual claims that property.

In this case, even if they could stay in the race on a technicality, you’ve outed them for being shady.

Who are the Edwards machine candidates? We know the Mayor is a machine member will he get some help from new council members?
