Well, I will say that if he/she/xi (sexist/cisist Gnome) could potentially be some form of a WB under some statute, of which I do not know, he/she/xi was not a WB under the Intelligence Community WB Protection Act because:

a. That act only applies to members of the IC, and the President is not a member of the IC. He is the head of the executive branch. The act does not give spies permission to circumvent the constitution and waive the executive privilege that belongs exclusively to him.

b. The subject of the report, the conversation between the president and the leader of a foreign nation is not an intelligence matter, it is a foreign diplomacy matter. At most, involves the State Department.
