In 2009, Kelley was appointed to the Brockton District Court by Governor Deval Patrick and served until 2013

President Joe Biden nominated Kelley to the United States District Court for the District of Massachusetts

The Senate confirmed her on September 14, 2021, by a 52–44 vote, and she received her commission on September 15, 2021

The challenge to the move came from Democratic states, which previously had the directive halted by a federal judge, but the Supreme Court in April 2025 said the department could continue the cuts while the case proceeded in court.

In 2025, the Education Department said the slash in funds was directed towards programs focused on critical race theory, DEI, social justice, anti-racism, white privilege and white supremacy.

These judges have no idea what their opinion mean because they are not writing them. The activist org attorneys are writing all these opinions and the judges are just signing them.
