Most contracts between individuals and companies compelling arbitration are adhesionary. I’d be fine with amending the FAA to put more of an emphasis on equal bargaining positions.

It’s a subject I’m totally ignorant about. However the cozy relationship between corporate America and AAA seems a little one sided.

I am going to watch this. I think Arbitration Clauses should be banned in consumer transactions.
They are hidden in all manner of form contracts- and consumers lack any bargaining power to negotiate the terms.
I’m at war with Wells Fargo right now in some ludicrously expensive FINRA arbitration - Wells Fargo writes the rules, prohibits discovery and there’s basically no appeal if the decision is wrong.
They are an abomination so far as I am concerned and I hope this Ian guy talks about it.

The first 15 minutes Ian goes into arbitration in general and the rest of the show he moves into a specific case. It moves fast.

And this is another area where MAGA’s main street populism could split with the country club GOPe types.
Without knowing anything specific, I guarantee you Wednesday’s client was handed a stack of papers to sign when they opened the account at Wells Fargo. In there was a forced arbitration agreement that her client didn’t read or understand. Moreover, if she wanted to bank at Wells Fargo (or at all because they’re ubiquitous), she had to accept the boilerplate terms presented to her. That is an adhesioanry contract because the bargaining power of the parties is so out of balance that it really does not exist for one side.
This has been rubber stamped by the GOPe and SCOTUS for decades.
This would be a good area for Trump to seek reform.
