This allegation is the one that would scare Flynn's lawyers the most. If my recollection of the federal sentencing guidelines are correct, that is a base minimum sentence of 121 months.

Flynn's not stupid and he has competent counsel (competent enough to bankrupt him in a year at least).
I wonder why they didn't think of that...
I would imagine that he didn't have counsel present during his FBI interview in jan 2017, and that is where he started digging his hole.
It boggles my mind that people don't know - don't talk to the feds (or local police) without counsel present. Yes, counsel is expensive but its sorta like Uber @ 2am and DUI.

The amount of work involved in a federal criminal case of this kind is so thorough and intense that any lawyer who did this pro bono would be a genius that would be on TV every single day, thereby raising their profile into the rarest of air in the legal world

There is a very small segment of the legal world who is well qualified to deal with this level of case. And they don't need to raise their profile.

He should have signed up for prepaid legal

I would imagine that he didn't have counsel present during his FBI interview in jan 2017
Something tells me playing dumb or pleading the 5th wouldn't have been the silver bullet our friend seems to think.

That's exactly what happened. He scheduled the interview without knowing what it was about and didn't ask to reschedule with counsel present. Next thing you know he's lying about sanctions conversations, op-eds, SF-86's....

I think saying you don't recall only works if you know you've never discussed the matter in question later with somebody else. If you say you don't recall but had later conversations about the same material then you've still got a false statements problem.
Pleading the 5th avoids criminal liability but the investigators are likely to start looking for your crimes.

it was stupid. And what is even more unbelieveable is that others continue to do the same thing. I suspect nunberg's meltdown was at least in part to getting caught doing this.
I would be really surprised if other campaign officials don't have this same problem.

I think he's basing that off Judge Sullivan's standing Brady order.

Pleading the fifth is really not advisable for a gov't official. However, it is always acceptable to say I would like counsel present.

A rule of thumb I've heard in political positions is that if you plead the 5th you should generally also resign. Is there another reason?

That is pretty much it. But in times like this I like to reference the god emperor.

He didn't commit a crime but plead guilty to it.
Bold strategy there.
