Fed DC Court Judicial Nominee is an embarrassment

What idiots thought this guy was remotely qualified to nominate him to the federal bench. This is a must watch video exchange between Sen Kennedy and a underqualifed candidate who is testifying for his nomination to the federal bench.

The guy spent his entire career is government administrative law, not litigation. He's being nominated for the federal district in DC where most of his cases will deal with administrative law.

This is a perfect example of moronic journalists pretending they understand law.

The journalist also didn't mind Kagan being nominated and confirmed as solicitor general without having ever argued in front of any court anywhere. The journalist also didn't mind when she was on the Supreme Court a year later.

The system is working.

It's unrealistic to expect every single nominee for every single position ever to be 100% qualified.

That's the whole damn reason the Senate has confirmation hearings.

First, political cronyism is rampant ON BOTH SIDES when it comes to appointing judges.

What you have stated indicates he knows (or should know) the subject matter of a significant percentage of the cases he would here, however, what Kennedy showed was he has no idea about the procedure of the job is has been nominated for and the job is almost all about procedure. He had no idea what a motion in limine was nor the subset Daubert motion (specifically ask about the Daubert standard). This is something every 1L would be able to answer, which is disturbing enough but when you are bucking to fill a position where MILs will be a significant part of your job you look silly. Add to that he had a horrible presence during the questioning, he looked slow witted and unable to form coherent answers. This man does not belong in a courtroom on either side of the table.

He may be a fantastic researcher and writer but he is not cut out for courtroom work. The idea a Federal judge needs OJT for things as simple as knowing what an MIL is begs sanity.

It is like hiring a car mechanic that doesn't know what a spark plug is or a plumber that is baffled when you ask him about PEX.

Meh. The Dauber Standard and MILs are incredibly easy things to understand. Petersen was on law review at UVA; I imagine he'll be able to comprehend what we teach 1Ls.

Judges work in the procedural world and it is clear he knows nothing about that world. You speak as though you are an attorney if you are and have done extensive trial work you have have been in a courtroom with a judge like this. They always make a mess of things while they are learning, while some become good judges and a few become great it doesn't make up for the cases they screw up while they are lost. Being on LR at VA certainly indicates he is intelligent and works hard but trial work and procedure is simply a whole different set of skills. It helps when a judge knows what an attorney is going to say after the first three words come out of his or her mouth. While not perfect it is analogous to getting an oncology researcher to perform a Whipple. They may have the capability but do you want to be their first (or tenth) attempt.

There is just no reason to nominate unqualified people like this to the judiciary, there are plenty of qualified candidates even if you require them to fit some stringent political mold.
