No matter what he does or doesn't do, their narrative is going to be the same.
So why in the world would you allow the narrative to dictate your actions when your actions have no possibility of changing the narrative?
Should they be thrown in jail? sure.
Pardon's aside... at a minimum over-charge them on anything you find and have the DOJ file motion after motion as they try and defend yourself and bankrupt them to the point they give up and plead guilty.
Because that's what the DOJ does. Doesn't matter if your name is Trump, Flynn, or Bobby the plumber. It's time to face the music and your own despicable tactics.

If the perps are given vague charges like Smith gave Trump, sure I can see the left making them martyrs.
But if they’re charged with malfeasance because they targeted political opponents with the power of their offices, and the evidence is available for public review, that shuts the martyr talk down.
Ex: Smith was presented with exculpatory evidence and refused to reveal it. That demonstrates to everybody that the guy was trying to convict no matter what, and deserves a conviction for it.
