most criminal proceedings don't allow depositions unless you're preserving testimony for trial (like a person is dying). pretty sure the federal rules are similar. in Louisiana you can't do depositions. discovery is a motion filed by the defense asking for everything the prosecution has. then the prosecution files one and asks for any documents that the defense may use at trial.

Only states I know of that have criminal depositions are Kansas and possibly Florida
