I know a guy who faced RICO with the bank as the victim. The victim actually testified for the guy telling the court what the guy did was how the bank did business.
The prosecutor then told the jury in closing argument the guy and the bank were the RICO "gang". So the victim became part of the guys RICO activity in the eyes of the jury and they found him guilty.
Judges will give prosecutors a lot of rope to prove guilt. Most judges are former prosecutors.

No the fix isn’t in. If Trump didn’t appoint this lady through the proper channels, everything she has done will get dismissed.
You should be able to bring charges again against James though.
