Just looked into it. If they're caught actually crossing the line, they can be turned back without a hearing, I believe:
Border Removal: An individual removed by ICE who is apprehended by a CBP officer or agent while attempting to illicitly enter the United States at or between the ports of entry. These individuals are also referred to as recent border crossers.
Also if they've been kicked out after a hearing and come back in, they can be removed without a hearing:
Reinstatement of prior Removal Order: The removal of an alien based on the reinstatement of a prior removal order, where the alien departed the United States under an order of removal and illegally reentered the United States (INA § 241(a)(5)). The alien may be removed without a hearing before an immigration court.

I tend to agree. In a perfect world, we would have instant deportation. Unfortunately, we have to deal with the real world and, frankly, I think this "lesser evil" is the best we're going to be able to do.

I thought it was mostly just media hysteria.
It's my understanding that illegal immigration peaked in 2007, then fell off and leveled out in 2009. And we're pretty much at the same 20089 levels today.
TBH, I don't really follow immigration issues much as it doesn't really affect me or really anyone I know. What I do know is that I was very thankful for their help in rebuilding after Katrina, Rita, Ike and Gustav.

Thanks, man. I think we can actually agree then. For the time being, sending them back immediately is a good band aid. Of course, something long term needs to be done or they will just keep trying to get in until they don't get caught. I appreciate you posting this, though.
