You bring up an interesting point, and one I think we get all wrong in our society. Two identical crimes that yield different results, through simply luck, get punished differently. I don’t think they should. Take, for example, two drunk drivers going down the same street at the same time on successive nights. Both pass out at the wheel at the same spot and swerve up onto the same sidewalk. On one night a pedestrian is there and is killed. On the next night no one is there and the drunk simply drives up on a lawn.

The first driver is facing a long prison sentence, but the second driver gets off by doing 100 hours of community service. But they committed the same exact offense. It was just blind luck that the second guy didn’t run over anyone, but the first one did.

Back to your example. Drag racing is a crime. We should have a certain punishment for it. Some young man who is drag racing should not face a harsher penalty because some other yo-yo lost control of his car. On the other hand, the young drag racer should not get off lightly because his compatriot did not kill someone. They should both be punished severely but not to the extent of murder. That’s just law as caprice.

Ok, now apply this logic to you shoving someone to someone else getting shoved 10 years ago in a different state who fell backward and hit his head.

Same offense. Your shove might normally not even be assault. Now you're facing a similar punishment as manslaughter. All because an odd occurrence 10 years ago in a different state.

They were racing. Racing each other. Had the young man who didn't hit someone else not decided to break the law and race, who would the other racer have raced?

Having owned a 600hp sports car with no cats, I'd get screwed with at least monthly--someone wanting to race. I'd just shake my head/wave them on. My fun is had at a drag strip.

You know what would happen? They'd drive on, no big deal. Had I started honking my horn, we'd race and potentially kill someone else.

I don’t think that’s the same offense. A shove can be light or violent.

But no, I’m not saying the guy who shoved someone who did not get hurt should be charged with manslaughter. I’m saying that the shove should be treated seriously by law enforcement and not taken lightly since no one was hurt. I think the unlucky offenders should be punished somewhat less severely, and the lucky offenders should be punished much more severely.

No catalytic converters. Illegal, but loud as hell and frees up some power. Even under regular throttle. Anyone driving around me would know the car runs without looking under the hood. I'd get people screwing with me all the time.
