They were being stored on Hunter’s laptop, and thus can’t be looked at.

Executive privilege is an office privilege not individual. Since the founding of the country the new President never produces the prior President's records because it dilutes the power of executive privilege and their records can then be produced when they leave office. However, OMB so Biden said screw that here you go. It's actually a good decision by the Supreme Court (and I would say by extension the country as it may rein in executive power) but bad precedent for future presidents.

In retribution, the next republican president needs to put all of Biden's(*) documents on a public server after waiving executive privilege. This includes images of the Executive Orders with drool marks and the bulk orders for Depends.

I think on the grounds that he's no longer President, which opens up a delightful can of worms re: Hussein's and Clinton's docs.

That's why no prior President has waived executive privilege for a prior office holder. OMB though.

Executive Privilege is as to the OFFICE, not the individual.

It is up to each subsequent president (as the head of the Executive Branch) to decide whether the papers of his predecessor(s) should be protected.

Until Biden, they routinely were.

But, it is his decision to make.
