for real though.. if he would have wore a gay rights shirt and been made to take it off this would be all over the media as a hate crime

Guns aren't allowed in schools. A kid can't wear a shirt with a picture of a gun on it in school. Just like you can't wear a shirt with a picture of a marijuana leaf on it in school.
The bigger issue here is this kid's a disobedient little smartass, or his parents put him up to this (which is equally shitty).
I'm all for exercising your rights, but use some discretion. People doing shite like this only hurts us.

I dont Blame West Virginia I blame 100% govt schools. He did it to be a little jack arse but that is why the 1st amendment is there to protect little jackasses like Marcum and people who make crucifixes out of dog crap, but the ACLU will come running to the defense of anyone but a Marcum, if parents spent as much time explaining the constitution and basic civics as we do only talking about (not participating just talking about) the NFL draft, College recruiting Football Baseball Softball etc we might dig ourselves out of this hell hole we have allowed ourselves to be put in.

small sidenote, the school doesn't have a policy against images of guns on shirts. looks like a teacher's personal agenda.

Do you know that for sure?
If you're wearing anything that could cause controversy they can make you change. A gay pride shirt would probably cause the same response, as much as y'all would hate to hear it. Why? Simple. They're not there to push an agenda or exercise their rights. They're there to learn. Teachers don't want any bullshite distracting their students.

#1 That is a pretty cute reporter
#2 Dress codes must be followed and there are consequences for disobeying
#3 It appears the shirt did not violate the dress code as written and only violated an administrator's sensibilities
#4 When did standing for your beliefs in this country (and in this case rights) become being a little jack arse?
= jack asses?
#5 When did failing to comply with an instructor in school become a criminal offense, necessitating police support? Many, many avenues of corrective action were available other than calling in the police. Simply suspending the child and having the parent take him home for instance?
#6 When did talking become equivalent with obstructing and officer?
#7 Does this school have a constitutional history class and will they be removing or not studying the first or second amendment in the curriculum? Do the administrators feel that young American students should not have a desire to "protect your rights"?
#8 Why are so many of you on this board ok with this overreach of authority? Most notable was the overreach of involving police and then the arrest for talking and less disturbing was the clearly forced agenda and discrimination by the school administrator.

OK, you are reading too much into this.
He wore a shirt to school with a picture of a gun on it. The admins certainly had the right to tell him to change it, for whatever reason. Probably some little candyass would have went home crying about seeing a gun at school.
You make excellent points, but IMHO, if it was that big of a deal to him, their are other ways to make his position known.
FWIW, I detest public education and what it has become.
Your first point is spot on.

Yep, but telling him to do so was not required it was at the administration's judgment that his clothing was inappropriate.
By the same token if the admin decided that bras were offensive as an outward example of gender bias and requested that all girls remove their bras they would be within their rights to do so based on the all inclusive “If in the judgment of the administration, a student is dressed inappropriately, the student will be required to change clothes or cover up inappropriate clothing before returning to classes". I would certainly hope my child would refuse to do so and deal with the consequences. I would also hope that the judgment of the administration would be questioned.

I agree. But why should he be limited to making his position known in this way? Do they prevent FUBU clothing? Shirts with junk food or candy logos? Shirts with flags from other countries?
Why involve the police? Why trump up a charge?
We have a dress code at my office. If my employees do not want to follow it they can and will be sent home without pay and/or eventually fired. I cannot however call the police out to enforce my dress code.

I've got no answer for you there, that does seem way over the top.
