In the case of terrorist acts, they do not fall under the legal system in the US. Terrorist are treated as enemy combatants and there fall under military law. Now granted in the US we only have water boarding but the military definitely uses enhanced interrogation techniques before trial. In fact the terrorist from 9/11 are still being adjudicated for their acts of terrorist. If found guilty they get the death penalty.
