If the SOB wants to give you that test youre going to jail. No need to take it just tell him I want the blood test.

Then someones just gonna have to sue for false arrest.

Or, if it escalates (oftentimes, if not many times, by the LEO) he could empty a magazine of Speer Gold Dot 9mm into your chest and get qualified immunity because the politician deemed it so, then go on to make his 8th false DUI arrest.

i wonder if you couldnt hit them with a civil rights suit in Federal Court...

He could file one, but he’d probably lose based on qualified immunity. The Fifth Circuit, which sits over LA, Texas, and MS and is one of the most conservative courts in the country, recently dismissed a false arrest claim against a game warden who arrested a guy for DWI, and the guy blood tested 0.0 for alcohol or drugs. It was the game warden’s third bogus DWI arrest. Qualified immunity. Case dismissed.
