Maybe. But she can still get it in (if her lawyer knew how).

She says he beat her. He says she made it up. She can put in contemporaneous communications to show that she is saying the same thing now as she said back then.

It’s an exception to hearsay.

Camille new trying out new ways to object... "Your Honor, we're going to object on hearsay" instead of just "Objection, hearsay"

don’t know if she’s lying or not. It’s not for me to decide. But It looks bad for her. Watching her on the stand was bad. It felt so unauthentic. She just looks like she’s acting. Turning her head to look at the jury constantly. It’s what an accused murderer does on the stand in desperation after they’ve been completely exposed. She’s basically coming across as overacting.

Just starting watching, didn't watch yesterday, she is 100% acting. I don't doubt some of these details are true, but she is a horrible liar and actor. Like JudgeHolden said, she flips a switch between bawling and coming apart to casual conversation as soon as the questioning switches moods. It's actually comically bad and there's no way the jury doesn't see it. I'll add that in my experience dealing with a BPD chick, you'd think they'd be great liars but they're actually horrible at it, you just get so sucked in you'd start believing in Santa Claus again if they spent an hour having a meltdown about it. And BPD lying looks EXACTLY like this, you can see them searching for words and details, emotional to even from one word to the other, being over the top to "prove" they're telling the truth (Amber staring down the jury), automatic tears at an emotional word, like hurt, embarrassed, love, etc

Did she just say she didn't do anything sexual during her role in Magic Mike XXL? I haven't seen it but I googled her character for that movie and there are pictures of her getting a lap dance from Channing Tatum.

No idea if she’s embellishing some of the emotional abuse, but it’s pretty believable overall. At least one other previous gf of Depp’s has said similar things. There is eyewitness evidence of him being emotionally abusive.

But that’s a huge difference from physical abuse. She is the only person in the world I’ve heard speak about him being physical. There’s just not enough there so far. She’s going to need more than her words to get people to buy it.

as I've said numerous times already... several of these incidents she's alleging could've already been corroborated by witnesses already called and the defense never got that corroboration

I struggle believing anything she says at the moment

Absolutely true about BPD women. They lie all the dang time and are actually really terrible about it bc they cant remember the previous stuff they said and it gets easily exposed. The stuff about exaggerating PTSD also hit home for me. My ex has continued to do that.

The issue that I see what that is, you can probably identify some instances of "emotional abuse" in at least half the marriages in this country. And probably the majority of Hollywood marriages at some point. Is that enough for someone to write an article about an ex spouse and call themselves victims of domestic violence and abuse? Its bullshite. Especially when Heard has been proven to have done the same.

I mean, his last shown text essentially apologized for some type of serious negative behavior. So emotional abuse is very believable. The marriage counselor also essentially said they were toxic for each other. However, most people said she’s the main aggressor. But emotional abuse both ways is pretty obvious at this point.

Legal question.

He’s a public figure.

Is this under the NYT v Sullivan standard of malice?

Absolutely not. This is at worst a toxic relationship. The word “abuse” scares people. But yes, it is technically abuse. It’s just not as serious as physical abuse.
