good luck with that one. what exactly is he a victim of? assault by buttery popcorn? no one is going to think that is a good reason to shoot someone. it's a far cry from Zimmerman's "he was crushing my skull on the concrete" defense. plus there are so many witnesses, the defense wont be able to just paint on a blank canvas.

The shooter is 100% to blame here. That he is a retired LEO makes it even worse: he should know better.

If you read what I wrote you will see that I mentioned both people doing simple things. I wasn't saying one or the other.
I have two daughters, I always made dang sure I didn't put myself into a position to leave my life in the hands of another. My pride didn't get the best of me and I can back down from stupid shite without feeling less of a man. I would also never pull a gun out in a situation like this because I would hope that I can control a situation enough to keep it from escalating to something of this level.

You didn't read the entire thing either. A simple action from either guy and nothing happens. I'm not blaming the guy, I'm just saying thinking about a situation before you throw popcorn at someone? Come on, really? Does he deserved to get shot over that? Hell no, but wtf?
Btw, I'm going to assume that his wife was thinking better of it because she was trying to pull him back when the guy shot so at least one of them had a cool head, it's really a shame that she couldn't get him to do it sooner.
The old man is at fault for pulling the gun, but so many things leading up to this could have prevented this from happening.

Well good, I'm glad you're not upset because that was not my intent, I was just trying to show how things get quickly out of control and how just doing anything different wouldn't have led to someone getting killed. I wasn't blaming anyone person or the other.
