What about this fluctuating work week method for overtime pay (Chinese overtime)? Anybody versed in that?

I’m also quick to guide any kids trying to follow that path to demand hourly pay at all cost.

Been salary for the last 23 years except for nov thru Feb this year I was hourly ($31 hr) and hated it. Too many bosses with each one wanting something different.

I’m back salary now and only 1 boss above me. Ya I work about 41-42 hrs a week but no more boss A wants this, boss B frick boss A do it this way, boss C frick everyone do it this way, boss D why isn’t it like this you’re getting written up, boss F high and don’t give 2 shits going home early

I’ll take salary with the better benefits

Salary non exempt rules are absolutely not the same as hourly. Hourly is 1.5 x pay over 40, salary non exempt is NOT. I want to say the Florida law is something like after 46 hours there has to be a benefit, but for hours 40-46 that’s allowed under a weekly schedule fluctuation.

ETA: That’s one of the entire purposes of salary non exempt over hourly, is not require tracking hours. If you had to pay salary non exempt over 40 you could also not pay them under 40 which is exactly hourly.
