Gotcha. I haven’t looked at that in decades. I just remember an architect suing a filmmaker for something similar and winning.

Not an attorney, but have dealt with people stealing my photos before.

Have you licensed it to The Chimes?

If not, you might have an issue because you haven’t enforced your rights, and set the value of the photo at $0. If you have licensed it your fee will set the base value of the photo.

The Chimes may have given them permission to use the photo. If you have no agreement with them limiting their use… you likely have no enforceable claim.

That said, you could still go after WBRZ for statutory value. If you have set you photo value at $0, you’ll probably limited to $200 in statutory fines, unless you can show WBRZ willfully used the photo. That could be worth $150,000, but hard to prove.

Good luck finding an attorney willing to take the case
