While I appreciate your open invitation to further discussion of that issue, I don't see the point really. Each of us seems convinced and comfortable with our position and I honestly don't see the legal implications as being seriously debatable.

Assuming the black guy was helped up eventually and later walked off on his own with no lasting ill effects, this was just a bully starting a fight and getting whipped.

This happens every day without charges ever being pressed. I would bet that most posters here have seen a bar bully get his arse beat badly and then revived and taken home. While I was at LSU, I saw too many to count.

Had the black guy ended up in a hospital (and able to press charges) then some DA might possibly have to at least consider the issue of excessive force in self-defense.

Fair enough, but my you'll note that my original response was to the poster who posited that "the white guy would never see a courtroom for that" which is a bit of a leap, legally.

i agree with this.

the NY guy didnt appear to have any serious injuries aside from a concussion. i didnt even see any blood.

no prosecutor should waste their time pursuing charges against the guy who successfully defended himself.

you want to see excessive force, go watch the video of the cop breaking the kid's arm

First, that wasn't the purpose of any of my posts in this thread, despite what you asshats keep trying to paint it as. I said that both of these people were pieces of trash and the fight was not necessary at all.

Lol, I'm gonna be honest, I don't think you really know what you have posted in this thread. You stated:

quote:

So you're assumption without any evidentiary basis justifies that level of battery?

and

quote:

The guy here almost did the right thing, instead he chose to turn back around and re-engage and almost ended up doing something incredibly serious.

and

quote:

But, if that justifies in your mind what the cab driver did after the fight was clearly over, then you clearly aren't going to change your mind.

So yes, you took issue with the excessive force used by the white dude (in addition to calling everyone involved trash).

You explained your position by admitting that you are a pacifist that has never been in a fight.

Hey, no shame in that in this asshat's view.

leads me to believe your not in the legal community.

As a general rule, I find that folks in the legal community can be very litigious and happy to debate anything, especially for pay.

Touché if that was your excellent point.

Hence, my use of the word "sensible" was not happenstance.

Well you seemed so confident of the legal ramifications of what he had done, I thought you might be an attorney.

I can make a sensible argument that the forced he used was not reasonable. (As can be seen by the numerous responses in this thread: "No problem with defending himself but should have stopped sooner.")

Kids being kids
I guess if he would have kept his mouth shut he could have avoided any conflict. I guess that fight limited his future in medical school.

Based solely upon that video, I honestly don't think that you can.

The victim is continually seen walking away and trying to move away form the attacker. The attacker is continually seen following and pursuing the victim.

The attacker approaches the victim and attacks him viciously.

The attacker is overcome and hit in the head until he is rendered threat-less. However, in the heat of the moment, the punches continue for 3-5 seconds after the attacker appears (from our helpful and non-violent camera angle) to be done.

If that attacker got up and walked away with no lasting damages, that is just self-defense and falls under the no harm, no foul rule.

And this of course assumes that you are NOT in a "stand your ground" State where the attacker would be put in prison just for claiming excessive self defense.

That's just how I see it.

Not wasting anymore time with someone who doesn't know what they're talking about.

Best of luck, man.

Dude, you've made it clear you don't know the law regarding battery or self-defense in Louisiana, or even how the criminal system works re DAs and prosecuting a case. Why would I spend time trying to teach it to you? You can teach yourself in RS 14.

And thanks for the late congrats on law school. Means a lot to me.
