This happens every day without charges ever being pressed. I would bet that most posters here have seen a bar bully get his arse beat badly and then revived and taken home. While I was at LSU, I saw too many to count.
Had the black guy ended up in a hospital (and able to press charges) then some DA might possibly have to at least consider the issue of excessive force in self-defense.
Fair enough, but my you'll note that my original response was to the poster who posited that "the white guy would never see a courtroom for that" which is a bit of a leap, legally.

i agree with this.
the NY guy didnt appear to have any serious injuries aside from a concussion. i didnt even see any blood.
no prosecutor should waste their time pursuing charges against the guy who successfully defended himself.
you want to see excessive force, go watch the video of the cop breaking the kid's arm

Well you seemed so confident of the legal ramifications of what he had done, I thought you might be an attorney.
I can make a sensible argument that the forced he used was not reasonable. (As can be seen by the numerous responses in this thread: "No problem with defending himself but should have stopped sooner.")

Based solely upon that video, I honestly don't think that you can.
The victim is continually seen walking away and trying to move away form the attacker. The attacker is continually seen following and pursuing the victim.
The attacker approaches the victim and attacks him viciously.
The attacker is overcome and hit in the head until he is rendered threat-less. However, in the heat of the moment, the punches continue for 3-5 seconds after the attacker appears (from our helpful and non-violent camera angle) to be done.
If that attacker got up and walked away with no lasting damages, that is just self-defense and falls under the no harm, no foul rule.
And this of course assumes that you are NOT in a "stand your ground" State where the attacker would be put in prison just for claiming excessive self defense.
That's just how I see it.

Dude, you've made it clear you don't know the law regarding battery or self-defense in Louisiana, or even how the criminal system works re DAs and prosecuting a case. Why would I spend time trying to teach it to you? You can teach yourself in RS 14.
