Minn. man gets 90 days for killing suspected burglar

Three guys attempt to burglarize a house. 19 year old gets shot - defendant says they were trying to run him down, victim's mother disputes this.

Victim's mother says her life is now "endless sadness and lifelong hell."

Not surprising, the burglars were fleeing, not in house, misleading title.

So fear for your life is not grounds to shoot? frick that judge.

That said, if he fired at a fleeing car, it wasn't fear at that point, it was vengeance.

Agree with all of that. I feel for the mom, but her son was in the process of committing a crime. Play stupid games and what not.

ETA: Jail time seems to be warranted for the homeowner.

Guy claims they were driving the car TOWARDS him...but they seem pretty sure the car was driving away. 90 days is probably a slap on the wrist (that I agree with).

Either way I can't find any sympathy for someone who gets popped trying to burglarize someone's home. It was really really easy for him not to get shot that night...by you know...not being a criminal.

You need to have a reasonable fear for your life. Shooting him on your front porch is one thing. Going back inside, getting a gun, and going outside to shoot at a fleeing (the bullets were found in the side of the vehicle) vehicle is quite another. I'm sure he was scared shitless, but 90 days in prison seems pretty favorable considering the totality of the situation.

Shouldn't been out stealing other peoples stuff and being a criminal. Got what he deserved.

I understand why this guy did what he did but he's real lucky that's all he got for shooting people fleeing the scene. Can't do that.

How in the world is this disappointing? His life was in no danger, the suspect was fleeing in a car when he shot at him.

No doubt. He plead guilty to reckless discharge of a weapon, a felony, when that discharge killed a man.

90 days is fortunate. Probably should have stuck with the manslaughter charge if only because of the optics of the plea.

The bottom line is if the kid didn't burglarize the home he would have never received a bullet. Every action has a consequence.

The kid never burglarized the home though really, he was on the deck, so he just trespassed,

Being killed is not a just consequence for trespassing.
