Seems to me this should be attempted murder. If, God forbid, the baby doesn’t pull through, I imagine they’ll tack on a 2nd degree murder charge, but surely this meets the standard of attempted murder, no?

I don’t believe the baby made it. We know a family member. Last I heard they were going to remove from life support. POS is going to jail for a long long time.

This is the bottom line, because I can’t imagine deliberately hurting any baby. But what’s somehow even more unfathomable to me is the idea that people like this don’t just lack the basic human decency required to avoid hurting babies, they hurt their own babies. It’s the complete antithesis of normal parental instinct. There’s so much wrong in that situation that I can’t see a way back from it, ever.
Years ago, I made a serious shift in my career path after being on the periphery of a case that was actually even worse than this one. It also involved death by abuse to a 5-month-old, but both parents were involved and it was one of the cruelest things I’ve ever heard in my life. Without getting into the ugly details, they basically toyed with the baby until it died the way a cat would play with a mouse. As soon as I read the case report and saw the autopsy photos, I knew I didn’t have the objectivity or emotional armor to continue in that particular line of work.
I’m generally a big believer in second chances, but some crimes are unforgivable and some people are just irredeemable. I don’t really care what happens to them as long as they never walk freely among the rest of us again.

Should be first degree......a defenseless child like that??????? Give him solitary confinement for life. AFTER the other prisoners get done with him.

I don’t think it works like that. Some of our resident Louisiana lawyers can help us out, but I believe it’s either got to be deemed pre-meditated or be done in conjunction with the committing of another felony like rape or burglary or the like. But Louisiana law is unique and there may be a different standard for 1st degree.

Pre-meditation has nothing to do with it in Louisiana.
The fact that it was a baby does in-fact make it murder 1. it is one of the possible aggravating circumstances that upgrades it.
