It certainly can, if you want to keep stuff under wraps. It's used as legal extortion to get a better settlement.
It is material when the spouse has a lot of assets, but far less than 1/2 are subject to community property laws (i.e. most of the assets were earned prior to the marriage). Then all of the private stuff becomes public unless that settlement is increased.
