Seems like it should have been a factor. I mean if I walk into the middle of an intersection under the influence and a drunk hits me it's not entirely his fault.

It doesn't affect veteran smokers to any appreciable degree that you would notice.

Ok I should have made a better analogy.
If you drive high you get a dui. If two cars collide on a road and one is drunk and one is high I would think both share the same penalty.
Weed is still illegal and still impairs you.

So if someone gets stoned, uses cocaine, takes pills, or trips then drives and kills someone, they are not subject to stricter penalties than a sober person? Driving under the influence only applies to alcohol?
If I've learned anything from the numerous biker's rights threads on the OT it is that cyclists are to be afforded the same rights and courtesies as vehicles when operating on public roads. With those rights and courtesies comes the responsibility of obeying all traffic laws.

One is illegal according to our criminal laws, the other is not.
There is no criminal statute in Louisiana specifically criminalizing bicycling under the influence to my knowledge, and the la supreme court concurred
Not to mention they are miles apart morally

A impaired biker can pose a huge danger when on a busy road like perkins. Car swerves to avoid the cyclist and crashes head on into oncoming traffic.
If you're on a road period you shouldn't be intoxicated.

That could conceivably happen but I've never heard of a story where a high bicyclist caused a fatal accident, whereas Ive heard of about a thousand where a blasted driver did

Vehicular homicide is a violent offense now. It wasn't in 2012 at the time of this incident but from the article he'll serve 5yrs then have to do 85% of the remaining 2.5yrs.
