I was driving to the Indy 500 in 2000 and had to cut through a small stretch of Illinois. As soon as we crossed into Illinois there were cops everywhere. Every 3-5 miles there were cops. Speed limit was 65. We had a radar detector but we were in a caravan of cars so we just went the speed limit. I was in a 1978 Corvette and crusing along a cop cuts through median and pulls me over saying I was going 80+. I respectfully challenged him and he started in with "well these tires arent spec for this vehicle so you have to get speedometer calibrated". The owner of the car leaned over and said "sir, i bought this car new in 1978 these are spec tires". I told the officer we wouldnt speed anyway because we saw cops everywhere. He proceeds to see the other 2-3 cars with us pulled over ahead of us and says "here's a warning. slow it down and be careful".

There is definitely a legal procress by which these poor innocent victims could use to crush the corrupt officers in court if they would choose to go that route. I wonder why they haven't.

More often than not, they have no recourse. Very little stolen property every gets returned.

Of course they could hire an attorney and sue the department. Why do think they didn't do that?

I am sure that some seized property is legit.

The problem is that way too often, thieves with badges and guns get to steal from citizens.

Seized cash is a line item in every little shithole town's LEO budget.

Gotta make those numbers and who cars if its some black or brown people? Hell, it might even be some white trash.

Just get the dog to "Alert". Hell, Bubba trained him. Ol' Blue will alert on command.

Your faith in the legal system is obviously greater than my own. Even if we ignore lawyers not working for free, what makes you think you're going to win in court?

Are you ok with police, who have ZERO legal training, making this call on the side of the road? Why even bother having a court system, just let the cops decide.

It's obvious we aren't going to have any middle ground on this topic. If you trust the police and the court system, that is your prerogative. However, I do not. I am sure there are good cops out there but, I am still going to treat every last one of them like a criminal just in case I do run across a bad one. Before you jump my shite and tell me my tin foil hat is on too tight, just remember that police aren't some highly trained or highly educated group. They frick shite up all the time and I don't want to be on the wrong end of one of their frick ups.

When we were adopting from Russia, we had to bring $40,000 in new, unmarked bills with us as that was the only currency accepted by the Russian government. If we were pulled over on the way to the airport or on the way home from the bank, should the police be able to confiscate that cash along with our vehicle without any charges against us?


Also, csb: Our bank had to order those bills for us as they don't typically keep that much new, unmarked cash on hand. The armored truck was robbed on the way to deliver that cash. Guess who was visited by the FBI that afternoon. Easily explained but then had to drive all over DFW to pick up any unmarked bills each bank location had to get the total needed for our trip the next day. So, if pulled over, we wouldn't even be able to show a large bank withdrawal slip in our defense.

I'm not remotely anti-cop and I think Civil Forfeiture is outright theft.

If you want to seize the funds then prove it was ill-gained money.

Our legal process is not founded on guilty until proven innocent.

Sure, the money probably came through criminal enterprise but our system isn't based on probably.

The store owner who lost his bank account because of multiple deposits is an even worse example of blatant theft.

Attorney's often take on civil cases with no up front costs to the client. They get paid when they win. People win large settlements of money all the time in civil suits against police agencies. It's not that much of a stretch to think they would have put up somewhat of a legal fight if the funds were seized illegaly.

Because they have no legal training. Law school is three years. Police academy is 90 days. Police are police, not lawyers. They may think they know the law, but they do not know the law.
