The fact that a prosecutor took it to trial is a damn joke. That entire law needs to be scrapped and rewritten.

Yeah, I know someone who knew a girl that got charged under the law. She drained her retirement to pay her attorney and they ended up just giving her probation then expunged the charge at the end of her probation. Her relationship was allegedly the summer after the kid graduated and he was 19. Kind of got the sense from my friend that was close to the situation that the DA thought the law was kind of a joke and he didn't really want to prosecute it.

It's a really, really bad law and it makes the state look more foolish and backwards than it is. If I recall, there were at least 3 different cases in Tuscaloosa that were rightfully dismissed - all within about 2 years of each other. All of them pertained to consenting individuals who refused to assist the prosecution. It's a horribly written law. At least the DA and judges in Tuscaloosa recognize that in these situations. Some other people in other parts of the country aren't so lucky.

I agree with them. If both parties are of the age of consent, it should not be not a crime.
It may be a fireable offense, probably is, but should not be a crime.

18 is an adult.

It can be against school policy, fine. It shouldn't be against the law.

This girl wasn't that lucky. From what I understand, his parents forced him to cooperate. It was also soon after the new law passed and hadn't really been challenged yet. It actually never even went to trial. She copped a plea deal.

Fire them, don't arrest them.

If it's my daughter, I'd probably assault them, but I still don't think it should be illegal for 2 adults to frick.

A male teacher was the one whose lawyer successful gained a dismissal, partially due to the unconstitutionality of the law. I believe he was the first to challenge the legality of the law. It was briefly ruled unconstitutional by another court a couple years later.
