it CAN happen. I doubt it happened in this case but it was an older gun so who the frick knows. If they hadnt deleted the video evidence maybe he could use this defense. since they did, I doubt it happened.

"I have an antique revolver. It’s 102 years old. It is just (barely) new enough that it is safe to fire modern ammunition. This gun has none of the modern safety features. The recommended method of carry for this pistol was hammer down on an empty chamber, because the firing pin is built into the hammer.
