Here’s how to lower the murder rate

Once the felon is convicted, the court let’s the victim’s family decide.
They can choose to let the court sentence them to prison or the death penalty where it’s legal OR the court turns over the murderer to the family to let them do whatever they want.
No questions asked.

This is a bit ironic, being that a significant contributor to the current murder rate are killings in retribution for prior killings.

People committing retaliation killings for drug rips and turf wars do not consider sentence or consequences prior to pulling the trigger.

Almost all of those types of killings require one to accept some chance of being killed during the act, if you are willing to take that risk a further risk down the road is unlikely to change the cost-benefit analysis for them.

Exactly. My whole point. This is why the family amendment would probably change their mind.
It would not be wise for me to type up what I would do to a murderer of one of my family members. It would make the revenge killing in ‘Law Abiding Citizen’ look like a trip to Disney World.

Saudi does something similar to what OP is suggesting for capital crimes:
The Death Penalty in Saudi Arabian Law
Both Sharia and Saudi Arabian statutory law allow for the death penalty. Capital offenses include adultery, apostasy, “corruption on earth,” drug trafficking, sabotage, (political) rebellion, and murder during armed robbery. 66 Under Sharia, murder and manslaughter are considered to be primarily offenses against a private right (qisas).67 Thus, while courts often impose the death penalty for murder or manslaughter, in these qisas cases the deceased’s family retains the right to insist on execution, accept monetary compensation—known as blood money (diya), or issue a pardon. If the family agrees to accept blood money in exchange for dropping its private claim, it can demand any amount it sees fit, and specify any time limit for payment it chooses.68 The court can also impose the death penalty as a discretionary punishment (ta’zir ) for actions it deems to be criminal, and Saudi Arabia is known to have executed persons convicted of witchcraft, most recently on November 2, 2007.69 Executions generally are by public beheading, although executions for adultery may be by stoning.
