Maybe years ago but not with dash cams required of most officers.

This should have been an open and shut case. He got off on a technicality.

Not sure that is actually a part of the field sobriety test.

5 posts related to race on page 1, in a thread that has very literally nothing to do with race. Racism is definitely dead though.

Pretty wild that rule about being observed for 20 minutes though... I'd bet that a ton of people get off on that rule

It's not about race. But the OT (who is tired of people making everything about race) had to make it about race with the comments.

Yeah, it is crazy. Once he blew over the legal limit, that should have been enough.

Dash cams don't smell alcohol and see a driver's glassed over eyes.

They just see and hear two people talking. A cop could easily let a judge go and later plead ignorance.

So much ignorance in this thread. From “eye astigmatism” to “count your ABCs” backward. ??

Sit in your car, be courteous and speak in clear SHORT, one word answers if possible. Do not breath towards officer (actually helps if all Windows are down) Hand him the requested documentation and keep hands on the wheel looking forward. THE OFFICER IS NOT BEING COURTEOUS OR FRIENDLY! He is doing everything in his power to get indications of impairment from you! If he makes you get out of the car, do so but refuse all tests, including him asking you to look at him. Be polite and ask for your attorney. D ont move at all or look at him...he is looking for physical shite to write on the report! He will show your violation, and also say he smelled the presence of alcohol on your breath...don't give him that ammo by staring or breathing towards him. Hire attorney and if they are decent and you aren't habitual, the charge can be beat.

I'm fairly certain that someone who is drunk is not going to be composed enough to maintain his cool like this.

The nystagmus eye test is the only objective test that can screw you. The heel to toe and leg raise tests are subjective and you can gaurantee the cop can find something wrong with the way you perform the tests even if you are sober. Not doing the tests is always the best option even if it means loss of license for six months or so. Hard to convict with no evidence.

He got off because the trial Judge wanted him to get off. There was enough to convict without the test. Passed out at the wheel on the highway is pretty good evidence of intoxication.

Hopefully, the bar association investigates bothof those arse wipes.

The better advice is not to drive while intoxicated.

I think a fair amount of it is to see if you can follow fairly simple directions.

Hand eye coordination is fairly unimportant when driving. Balance is fairly unimportant while driving. Ability to anticipate is important. Ability to focus is important.
