I think it depends on the state, but if someone is killed while you are committing a violent felony then you can be charged with that person's death even if you didn't directly kill the person yourself.
A couple of years ago in Baton Rouge a couple of men were committing armed robbery at a store when a bystander shot and killed one of the robbers. The surviving robber was charged with his death. At the time I was really surprised to hear it because I didn't know it worked like that, but if you think about it I think it makes sense. The person committing the crime created a violent situation where someone's death would be a reasonable expectation. Higher than a normal situation at least.
The title itself sounds kind of bad or unjust, but I don't think it is. This man deserves to be charged. He pointed a gun at a cop. He created the situation that led to his daughter's death. The constable was trying to respond appropraitely to the situation. Bad things happened.
