They are going to have excavate and repair that from the outside. No matter what the contractor tells you there is no magic product that can be applied to the inside of the wall that will stop the moisture.

You seem knowledgable on this. Is it that difficult to not get it right during the initial repair?

Without knowing what was done the first time. I'm guessing he spent as little as possible like applying a sealer to the outside of the block wall.
To do it right and last you need to spend the money on material other than a sealer and also give the water some place to go with drainage.
The contractors goal is get this problem solved until the 6 years is up. Your goal is to get this problem solved permanently.

It's going to depend on the state. LA has the Bew Home Warranty Act. Not sure what/if TN has
