wasn’t there a pre-trial hearing on this
WGN - Judge rules on admissibility of defense’s alternative theories in Delphi murders
quote:
In her Sept. 4 order, Gull sided with the prosecution, writing that the “burden was on the defendant to show a nexus between Odinism, cult or ritualistic killing” and specific individuals cited in defense motions.
“The case law is quite clear that the nexus must not be based on speculation, conjecture, rumors, or hearsay, but rather on admissible evidence,” Gull wrote in her order. She added that the defense had “failed to produce admissible evidence” demonstrating such a nexus during hearings.
“The Court will not permit the evidence submitted by the defense in support of their arguments regarding third-party perpetrators in the trial of this cause as the probative value of such evidence is greatly outweighed by confusion of the issues and its potential to mislead the jury,” Gull wrote.

Thank you. I’ve been fascinated with this case from the beginning and believed for a long time it might never come to trial.
I’ll do my best, but I have a funeral to attend, a milestone family birthday, and my dad is having day surgery, all this week, and a jury duty summons for Monday. Hopefully there won’t be any cases going to trial in Podunk, Louisiana and I don’t have to show up just as things begin to unfold in Delphi.

Bingo! Just because the judge isn’t allowing the defense team to throw mud against the fence to see what sticks doesn’t mean she’s somehow in the prosecutor’s corner.

Hope all goes well with your dad.

There was a lengthy rambling memorandum chock full of typographical errors and bad grammar that was “inadvertently” attached to a defense motion that outlined the Odinist theory that was … something else.
It named specific individuals in the surrounding areas who allegedly practice(d) these rites and basically accused them of committing the murders, all based on blood evidence on a tree that one consultant theorized to be a runic letter, and some tree branches allegedly placed on top of a victim that might form a rune. The named individuals reportedly had alibis and at least one of them retained an attorney to send cease and desist letter to the defense.
I don’t have time right now to go into the defense employing an sheisty investigator who accessed the evidentiary files and sent excerpts and info to some internet sleuth through a go between. The middleman committed suicide, he was an officer in the Indiana National Guard. At least that’s the essence of it, cannot remember exact details and sequence just now. At one point the judge removed these defense attorneys as public defenders but they appealed and Indiana Supreme Court reinstated and here we are.
Edit: fixed typo

Thanks, it’s supposed to be day surgery only.

Jury selection is now complete.
Pretrial motions will be argued tomorrow and Thursday morning, then trial supposed to begin sometime Thursday. The jurors are from Allen County and will be transported across the state to the Carroll County vicinity and settled into their sequestration lodging tomorrow.

That is one story I am ready to hear.

I have also heard a rumor that the tip was mislabeled (and subsequently misfiled) under the last name “Whiteman,” which was the street Allen lived on. At some point in 2021 the investigative team did a “reset” to begin going over the evidence again from square one and it was “rediscovered” at that time.
My question is why didn’t the game warden detailed to following leads in the initial aftermath (known as conservation officer in Indiana) ever follow up —even casually— on someone about the tip. Or maybe he did and got told to buzz off or that it checked out or who knows what. The GW/CO is purportedly on the state witness list.

So opening statements are set for Friday, not Thursday as I had posted earlier.

There's no evidence of anyone else being there with the girls right? I mean, NONE?
None has been disclosed or leaked. Today the defense said during voir dire that a hair was found in Abby’s hand that didn’t DNA match RA. There could certainly be more than one plausible explanation for that. It’s interesting that the defense hasn’t leaked this as they did the frankly wild assertions of the Odinist angle in that poorly written memoranda that was “inadvertently” attached to a defense motion.

Was there anyone else seen in the area that day using the trail that are unaccounted for?
There were other people on the trails that day. Temps were in the mid to high 40s, fairly warm for mid-February in Indiana, and there was no school that day. There were several individuals or groups who saw someone fitting the general description of Bridge Guy. With the tight timeframe, it seems likely they all saw the same guy, presumably RA.

the fact that the guy admitted to being there PRIOR to the police going public with photos of a possible subject. There's some pretty damning evidence.
I definitely think so.

Thanks.

I’ll look around for a breakdown of costs but prosecution, public defender, jail (RA hasn’t been held in CC jail this entire time, so it seems likely the county has to pay the other jurisdictions for housing him), jury sequestration and courthouse security are likely pretty high on the list.

4.3 Million seems kinda high?

It’s a lot of money for sure. I’ve been told that a spreadsheet screenshot made it to YT a few weeks ago (a still from a news video) but was taken down because of the gag order or for privacy reasons, not sure exactly. I guess at some point an accounting will have to be made public.

WHTR - Over $1 million has been spent on the Delphi murders trial; how much more will be spent?
Found it! This article gives a good breakdown of costs, but as of six weeks ago said only about $1M had been spent.
