Oh, yeah, forgot about that one - which is a widely criticized study that doesn't distinguish bad outcomes from medical error. For example, that study would find that someone at high risk for post surgery infection and who had an unremarkable surgery, but later developed an infection that caused death, died as a result of medical error.

There is still a good bit of settling and gamesmanship despite the medical review panel determination. But ya, past that it is pretty difficult.
Tort reform is "bad" for the lawyers on both sides, since the caps also limit how much you can charge for your billables on the defense side.
