Because it implies intent to misuse the funds - you actively used money you knew wasn't yours.

If they money had been deposited in an account that is already interest-bearing, that would be different b/c you can show lack of intent. You might very well get to keep the interest in that case although your bank would probably try to take it under some pretext.
