Built a house 14 years ago with out buildings at some of the houses in said neighborhood. Two years later I submit a set of plans for a 40x60 building. HOA says no out buildings and so I send pics to them of out buildings in hood. They call and say, those are grandfathered in. I called an attorney for help and he said that if a HOA covenant is not enforced and goes unenforced for six months, It may not stand up in court as enforceable. Spoke with neighbors that already had out buildings and they had no liens on their properties. Presented all of this to the president of HOA and proceeded with build out.

If you wanted a copy of the guidelines, you should have withheld your dues until they got you one.

A lot of these HOAs are all bark and no bite. They'll threaten legal action, but when push comes to shove they won't file for an injunction.

I can't imagine buying a house with an HOA and not asking to see the rules before signing anything. I like to think OP just paces in his driveway waiting for someone to deliver the precious documents instead of proactively figuring it out himself

I'm an HOA board member in my neighborhood and I advise you to please read your HOA restrictions about improvements which should have been given to you at closing or are listed on a website. If not, knock on some neighbors doors that you've met and ask. We use a management company who our neighbors can call and get a copy.
Remember, HOA board members are neighbors just like you. We don't get paid to do it and we pay our dues in full just like you. We aren't some bad guys who wanna screw you over.
Get a copy of the restrictions and read them. Then request an architectural change and wait for their response. It's a very easy process.
Also HOA's can't do anything about parking in the street except send out emails and letters asking people not to and police only write tickets if you park going the wrong way or are blocking a mailbox or driveway.
It sounds like you live in a great neighborhood. Don't screw that up by starting off on the wrong foot. Hope this helps.

You are clearly not attempting to get a copy oft he guidelines. So therefore you are at fault if it is out of code. You have been told it will not be allowed and want to do it anyway? Why did you not get all information on HOA before moving in? You sound like an irresponsible homeowner.

It's your responsibility to know the HOA rules, not anyone else. No one is supposed to hold your hand through life. Act like an adult, go to the HOA board and ask if you can build the "nice" 8x10 shed.
They will tell you yes or no then you move on.

We have an architectural committee that has to approve any plans for additions/sheds. Basically it has to look just like your house and can't be less than X feet from your property line and can't be in front of your house.
