I'm going thru a divorce. I have my own business. Wife's name isn't on it. She's trying to claim it as a marital asset. Thing is, my business is worth maybe 400k. It's in debt 335k. How does this work? If she tries to claim the 65k asset, doesn't she have to claim 167k of debt? (That would be half)
I live in Alabama. She has worked the whole marriage and has well over 100k in her retirement/pension. 11 year marriage.

God bless you. I hope you take her to the fricking cleaners. I have no idea how Alabama works but common sense would say the business is only worth the assets minus the liabilities.

Need more information - did you own the business before marriage? Is it a corporation or LLC, or are you a pure sole proprietor?

If you owned the business prior to marriage, you can claim it as personnel property. If not, you're screwed.

I bought it after we were married.
How am I screwed? Neither party gets to claim assets and no liabilities.
